The car and light motor vehicle rental agency SDX Smederevo (hereinafter referred to as the \"Lessor\") rents the vehicle to the Lessee (hereinafter: the Service User) for the period and under the conditions specified in this agreement.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

Article 1. <\/div><\/span>\n\t\t\t\t\t\t\t\n\t\t\t<\/path><\/svg><\/span>\n\t\t\t<\/path><\/svg><\/span>\n\t\t<\/span>\n\n\t\t\t\t\t\t<\/summary>\n\t\t\t\t

\n\t\t\t\t
\n\t\t\t\t\t\t\t\t\t

By their own handwritten signature, the Service User agrees to accept and comply with the following general terms, and to assume all rights and obligations arising from this agreement:
\u2022 To accept the prices and other rental terms stated in the current price list as an integral part of this agreement;
\u2022 To be at least 21 years of age and to have held a valid driving licence for a minimum of two years;
\u2022 To receive the vehicle in proper working order, with a full tank and all accompanying accessories and documents, and to return it in identical condition;
\u2022 To return the rented vehicle within the period indicated on the front page, or earlier at the Lessor's request, with a tolerance of 60 minutes' delay, after which an additional rental day is charged;
\u2022 To request the Lessor's consent for any extension of the agreed vehicle use period 24 hours before the vehicle return deadline expires;
\u2022 To properly maintain and look after the vehicle during use;
\u2022 Not to use the rented vehicle:
a) Under the influence of alcohol or drugs;\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<\/em>
b) For unlawful purposes (e.g. criminal offences, customs and foreign currency violations);<\/em>
c) For driver training;<\/em>
d) For transporting passengers or goods for compensation;<\/em>
e) For towing other vehicles or trailers;<\/em>
f) For participation in motorsport events;<\/em>
g) For transporting animals, highly flammable or explosive materials, materials with strong or unpleasant odours, or bulky items that could damage the vehicle;<\/em>
h) While subject to an active protective measure banning them from driving motor vehicles;<\/em>
i) While their driving licence is expired<\/em>
\u2022 To use the vehicle solely for their own needs and not to rent or lend it to a third party;
\u2022 To drive the vehicle personally, or have it driven by a person authorised by the Lessor to drive the vehicle and registered as an additional driver in the vehicle rental agreement.
\u2022 Not to load the rented vehicle with persons or objects beyond its permitted carrying capacity;
\u2022 Not to take the rented vehicle across the state border of the Republic of Serbia, including the administrative crossing with AP Kosovo, without the Lessor's written permission (authorisation);
\u2022 Not to make any changes to the vehicle's parts, assemblies or devices without the Lessor's consent, nor to dispose of the vehicle.<\/p>

Article 2. <\/div><\/span>\n\t\t\t\t\t\t\t\n\t\t\t<\/path><\/svg><\/span>\n\t\t\t<\/path><\/svg><\/span>\n\t\t<\/span>\n\n\t\t\t\t\t\t<\/summary>\n\t\t\t\t

\n\t\t\t\t
\n\t\t\t\t\t\t\t\t\t

If, through negligence, damage occurs to the tyres, wheel rims, the vehicle's undercarriage, the vehicle's drive mechanism, or any other damage is caused to the Lessor's vehicle without a traffic accident having occurred, the Service User is obliged to notify the Lessor immediately and to compensate the Lessor in full for the cost of repairing the vehicle, as well as for the lost daily vehicle rental according to the current price list for the duration of the vehicle repair.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/details>\n\t\t\t\t\t\t

If the Service User breaches any provision or condition of Article 1 or Article 2 of the Rental Agreement, they undertake to compensate the Lessor for any and all damage arising as a result, the extent of which shall be determined by the Lessor.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/details>\n\t\t\t\t\t\t

For the loss of documents or keys, we charge compensation of 200,00 euros in the dinar equivalent.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/details>\n\t\t\t\t\t\t

The Lessor will reimburse the Service User, upon presentation of proof of payment, for the costs of regular vehicle maintenance (excluding vehicle washing costs), subject to the mandatory prior consent of the vehicle's Lessor.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/details>\n\t\t\t\t\t\t

The Service User undertakes to pay the Lessor immediately, upon the Lessor's first request:
\u2022 The daily rental amount for the rented vehicle and any other charges that apply;
\u2022 For the use of the vehicle, according to the current price list;
\u2022 The amounts of any fines imposed on the Service User in connection with the use of the vehicle and caused by the Service User's fault (traffic violations), as well as parking tickets.

In the event of failure to settle the costs arising from this agreement, the Lessor will initiate court proceedings against the Service User to collect its claims and will charge default interest.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/details>\n\t\t\t\t\t\t

Article 8. <\/div><\/span>\n\t\t\t\t\t\t\t\n\t\t\t<\/path><\/svg><\/span>\n\t\t\t<\/path><\/svg><\/span>\n\t\t<\/span>\n\n\t\t\t\t\t\t<\/summary>\n\t\t\t\t

\n\t\t\t\t\t\t\t\t\t

When using the rented vehicle, the Service User is, in accordance with applicable legal regulations and insurance rules, insured for statutory liability for damage caused to third parties, and the vehicle is also covered by a comprehensive (CDW) insurance policy with a 20% excess payable by the renter. Damage to the vehicle valued at up to 100 euros is not covered by the comprehensive (CDW) insurance policy, and the renter is obliged to pay for such damage. The comprehensive (CDW) insurance policy is valid only with a police report for the damage caused to the vehicle.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/details>\n\t\t\t\t\t\t

Article 9. <\/div><\/span>\n\t\t\t\t\t\t\t\n\t\t\t<\/path><\/svg><\/span>\n\t\t\t<\/path><\/svg><\/span>\n\t\t<\/span>\n\n\t\t\t\t\t\t<\/summary>\n\t\t\t\t

\n\t\t\t\t\t\t\t\t\t

The User undertakes to always lock the vehicle when it is not in use and to keep the keys with them, and if the vehicle is fitted with an alarm system, the Service User is obliged to activate it every time they leave the vehicle.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/details>\n\t\t\t\t\t\t

Article 10. <\/div><\/span>\n\t\t\t\t\t\t\t\n\t\t\t<\/path><\/svg><\/span>\n\t\t\t<\/path><\/svg><\/span>\n\t\t<\/span>\n\n\t\t\t\t\t\t<\/summary>\n\t\t\t\t

The User undertakes, for the duration of the rental, to look after the technical condition of the vehicle, regularly check the coolant, oil and tyre pressure, and carry out
the necessary oil changes, subject to the prior consent of the vehicle's Lessor. Any costs the User incurs as a result may be reimbursed against submitted receipts. The User is deemed responsible and is obliged to compensate for all damage arising from improper maintenance of the vehicle.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/details>\n\t\t\t\t\t\t

All damages to third parties caused by the Service User while providing inaccurate or false information about themselves, their address or their documents shall be borne exclusively by the Service User.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/details>\n\t\t\t\t\t\t

For the duration of the rental, the User shall bear the costs of garaging, parking, any traffic fines and other unforeseen costs. Likewise, should the vehicle be seized by the police (MUP), the User shall be charged for each day, for as long as the vehicle is not at the disposal of the car rental Agency, according to the vehicle rental price list. The Lessor is entitled to subsequently charge the Service User for all violations or fines received later for which the Lessor is charged as the owner of the vehicle, as well as for the cost of notifying the User of incoming fines in the amount of 2000,00 rsd, and, by way of vehicle depreciation, for exceeding a speed of 150km\/h in the amount of 300 euros in dinar equivalent at the middle exchange rate of the NBS.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/details>\n\t\t\t\t\t\t

The Service User is liable for all damage:
a) caused to the vehicle by them or by a driver authorised by them (additional driver) while under the influence of alcohol or drugs;
b) if the damage was caused deliberately or through gross negligence while driving. The damage is assessed by an extraordinary inspection of the vehicle carried out by a service centre with which the SDX Agency has a business and technical cooperation agreement.
c) if the driver did not hold a valid driving licence at the time of the damage;
d) if, at the time of the damage, the driver was subject to a protective measure banning them from driving a motor vehicle;
e) if they fail to report the damage to the police and obtain a police report for it;<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/details>\n\t\t\t\t\t\t

The Lessor will not compensate the Lessee for the loss of, or damage to, personal luggage located in or on the rented vehicle.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/details>\n\t\t\t\t\t\t

The Service User shall bear all damage to the vehicle, as damage caused by negligent use of the vehicle, if they grossly violate any general provision of this contract to which they committed themselves by signing this contract.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/details>\n\t\t\t\t\t\t

Article 16. <\/div><\/span>\n\t\t\t\t\t\t\t\n\t\t\t<\/path><\/svg><\/span>\n\t\t\t<\/path><\/svg><\/span>\n\t\t<\/span>\n\n\t\t\t\t\t\t<\/summary>\n\t\t\t\t

\n\t\t\t\t\t\t\t\t\t

In the event of a traffic accident, the Service User undertakes to protect the interests of the Lessor and its insurance company by:
\u2022 recording the names and addresses of the participants in, and witnesses of, the accident;
\u2022 securing the damaged vehicle;
\u2022 immediately notifying the Lessor of the damage, even when it is minor;
\u2022 calling the traffic police and waiting for them to arrive.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/details>\n\t\t\t\t\t\t

If the Service User fails to take the above measures in the event of an accident, they will be liable for all consequences and damages the Lessor suffers as a result.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/details>\n\t\t\t\t\t\t

If the Service User does not return the vehicle by the agreed date stated on the front page of the contract and does not settle their debt, the Lessor is authorised to file a criminal complaint against the person with the competent public prosecutor's office and to report a search for the vehicle to the competent Secretariat of Internal Affairs.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/details>\n\t\t\t\t\t\t

The minimum rental period is 24 hours<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/details>\n\t\t\t\t\t\t

Article 20. <\/div><\/span>\n\t\t\t\t\t\t\t\n\t\t\t<\/path><\/svg><\/span>\n\t\t\t<\/path><\/svg><\/span>\n\t\t<\/span>\n\n\t\t\t\t\t\t<\/summary>\n\t\t\t\t

\n\t\t\t\t
\n\t\t\t\t\t\t\t\t\tTyre wear is measured before the vehicle is picked up. If a tyre is worn beyond the limit for the number of kilometres driven, the Lessee is obliged to pay the cost calculated by the Lessor.\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/details>\n\t\t\t\t\t\t

The following are charged additionally:
\u2022 Delivery or pick-up of the vehicle outside Smederevo, and outside working hours;
\u2022 Washing of a heavily soiled vehicle;
\u2022 All damage to the interior and exterior not related to a registered accident, and an amount of 150 euros for any damage caused by the use of cigarettes inside the vehicle.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/details>\n\t\t\t\t\t\t
